The SML working group recently agreed to make this change, so this will be a matter of spec compliance once the next draft is issued.

It turns out the current code is already handling this.

until you have the new smlif schema, anything exploiting this will not validate even if the downstream code tolerates it, so not sure if it should be fixed or blocked
