From the spec:

The validation-mode element of the persistence.xml file determines whether the automatic lifecycle event validation is in effect. The values of the validation-mode element are AUTO, CALLBACK, NONE. The default validation mode is AUTO.

No the fix could not be checkin because of the bug 280526.

Additional note from the spec:

javax.persistence.validation.mode property — corresponds to the validation-mode
element in the persistence.xml. See sections 8.2.1.8 and 3.6.1.1.

Note:
Dali will be supporting both validation mode specification form, i.e. element and property. However, Dali will only write out the element form to the persistence.xml. 
If the user use the property form to specify the validation mode, the persistence.xml editor will convert it to its corresponding element form.

Dali now creates and maintains the validation-mode element of the persistence.xml
