The 'New XML' creation code path could do with a good scrubbing. This bug is
opened as a place holder to remind us to attend to this.

I've morphed this bug into something a bit more structured that achieves the same ends.  Gabriel, will write some JUnit tests for the 'New XML' function and can flush out any bugs or design issues as a side effect of this work.
